No wonder I never get to play any of those cool solid state recreation games in VP, I always answer "No" when it asks me if I'm legally entitled to them! I guess it's just originals and EM's for me!! whistle.gif

There is a "fair use clause" in the copyright act.

If you are using the information to learn, and not reselling or using the information for applicable or commerical purposes then you are legally entitled to use it under "fair use". Ie boot legging a copy of Excel to learn about spreadsheets - Legal. Using it to keep track of your movie collection - not legal (applicable purpose).

Entitlement is another legal concept.
If you own a machine you are "entitled" to make it work. This may include copying roms, manufacturing your own parts etc. You can then sell your machine and its legal. This does not mean you can manufacture copies or simulations and resell.

You see both of these concepts in action in the auto industry. Ie 1968 Ford Galaxy 500 - Fenders are not a stock item, there are 20 web sites you can buy either custom or parts manufactured to orginal specs.

Applicable practice is another concept
Pinball Roms typically have been freely distributed. I am sure the manufacturers intended these to be used on real machines. Ie who would use a Simpsons Rom on a Kiss machine ? so if there is no commerical value to the information being distributed there can be no restriction on further distribution. If there was a license agreement or a document signed that restricts distribution that overides this.

Bottom line as long as you don't seek to make a profit, or use the software in a manner that would commerically harm the orginal vendor. Ie make copies of a product and and sell them, you have not denied the orginal vendor a sale (commerical harm). Ie I convert my Civic into a Bentley look a like. Neither Honda nor Bentley are chasing me down the block.

@The Loafer: Except you were the one at the other site who kept saying that Polygame was at substantial risk of getting his ass sued (for this issue) during the recent drama over there. And you said it not once but repeatedly. If you had gotten your way a huge number of tables would have had to have been taken down and certain new ones would not be allowed to be created or shared.

Who said I have changed my mind? This entire SUBJECT, as presented in this thread, has been done numerous times, to death and in some cases, it's to stir up trouble. My intent at the other site was to support anyone who feels this is a risk too great to bear because that is THEIR perogative.

News flash for you: If Noah says "we have to cut back on Stern tables from the present system to 8 years back, it's too great a risk for me to host", well, there I will be, supporting him and putting up points in support of him when he gets attacked for watching his own ass. It drives me nuts that people who have NO legal liability and who have NO legal expertise tells those who share the legal burden of hosting grey area files "no, no, you have nothing to fear, keep going as you were" because of what I perceive is a "gimme gimme" attitude.

That is BS, I never said these should never be made available, I'm saying its the perogative of site owners/admins to make that call themselves and I will support them. I never said they should be taken off the internet, if someone feels its no issue, then let them take the risk, no problem with that at all, members should not impose their views though which is what was happening.

ie: I'm a pro-choice type of guy smile.gif. This has been something discussed for 11 years VP related (If I recall correctly) and even earlier for emulation in general. It's not really bringing anything new to the conversation and its beating a dead horse until there's nothing left of the old hag. I've been around a while, seen it all and its a tiring subject. But if there's anyone getting "entertainment" out of it, more power to them, enjoy the thread.

I don't particularly like the subject either. However I am not adverse to discussing it if and when new developments occur. But until such time, I agree, it is beating a dead horse BeatingDeadHorse.gif smile.gif

And as far as Noah is concerned I presume he knows way more than me about the subject so I would never presume to tell him what to do smile.gif I agree that the admin here or elsewhere should make their own decisions, and respect that they can and will do that, therefore there is no need to trash some members opinion before the admin has made a decision.

Perhaps that was a wrong choice of words. I don't want to get into it here but will say that you were vehemently supporting someone's rational for wanting to remove a large number of tables from the internet and prohibit the creation and access of many others. That is why I assumed you wanted them off as well. Difficult to assume otherwise. And you were strongly arguing with anyone who put forth the idea that the "threat" was being overstated, in other words, that it is safe to continue this hobby. You were fear-mongering -- arguing that it is unsafe to the admin to continue the status-quo (the hobby as it is). In the end their decision disagreed with you.
